According to records obtained by ESPN, the incident occurred when Cleveland was driving a Ford F-250 and was pulled over by police at 10:25 p.m. for failing to maintain his lane. This marked the beginning of the DUI investigation.

When stopped, Cleveland admitted to drinking three to four beers at a country club but claimed he had not consumed alcohol within the last two hours. He agreed to undergo field sobriety tests and subsequently took a breathalyzer test, which showed a blood alcohol concentration (BAC) of .178, more than twice the legal limit of .08. After being arrested, he was taken to jail, where a second breath test showed a BAC of .161.
